Instructions *

The client must ensure that all their instructions and expectations regarding the booking and session are agreed in writing.

Licence Granted to the Client *

The copyright in all Photographic Works resulting from the booking/photoshoot remains the property of the Photographer. The Photographer grants the client a commercial license to use the images selected by the photographer and presented to the client. This includes the right to use the images in perpetuity. Images may be manipulated included photographic works and adding text. However the copyright of manipulated images still remains with the photographer.

Conditions of Licence *

This Licence to use, and the right to use, the photos comes into effect from the date of full payment of the Order, except where the Photographer gives express written permission.

Reservation *

The client understands and agrees to pay a non-refundable reservation fee, to secure the date and time of the appointment, and for the photographer to not make any other reservations or accept any other clients for that time.

Payment *

The client shall pay the photographer the various amount payable in accordance with the booking. The balance is due either 7 days before your session date, or at the time of booking if the booked session date is less than 7 days away.

Cancellation or Postponement of Booking *

Where the Client cancels or postpones a Booking appointment within 24 hours before the photosession, the client must pay, at the Photographer’s discretion, the amounts that have already been invoiced or are due as outlined on the Booking agreement, regardless of whether the appointment is attended or not. Prior to 24 hours the photographer will return any invoice paid, minus the non-refundable booking fee of $100.

Covid-19 *

If either the photographer or the client are sick the session will be rescheduled until everyone in your or my household is well. There is no fee to transfer the session date due to illness. I understand that practice guidelines can change at any time due to the nature of Covid-19 and that guidelines provided by the Ministy of Health will be followed regarding safe practice of the photoshoot. These guidelines will be provided before the photosession.

Transfer of Booking *

The Booking appointment and any fees paid prior to cancellation or postponement of the appointment are transferable to another person, as if it were the original person, as long as the Booking is similar and the date and time of the appointment are not changed. This must be agreed with the photographer.

Refunds and Reshoots *

Refunds and re-shoots will not be given for poor choices of clothing, make-up, hair, weather related issues, or by not following the recommendations of the photographer. Refunds and re-shoots will not be given for those who do not co-operate for the session, eg. children who cry or do not smile. Refunds and re-shoots are given entirely at the discretion of the photographer.

What The Session Fee Includes *

Your session fee/booking fee covers the time and skill of the photographer, any props or clothing that the photographer may supply and the wear and tear of the equipment used during the session. It also includes the time and effort to produce your beautiful gallery.

Final images *

The client understands that the photographer's decision regarding the images is final. The final images will be digital images, supplied as an online gallery for the client to download. A link to this gallery will be made available via email. The gallery will remain available to the client to download for one month from the date the link to the gallery is emailed to the client. The client understands it is their responsibility to download their images within this time.

Model Release *

The Client acknowledges that the purpose of the creation of the Photographic Works includes the right of the Photographer to: (a) Enter the Photographic Works into photographic competitions or awards and for their use in any material published in connection with promoting those competitions or awards; and (b) Advertise or otherwise promote the Photographer’s Work; and (c) Submit the Photographic Works for display at art galleries or other premises; and (d) Use the Photographic Works for any other purpose within the Photographer’s business activities.

Responsibilities to Contractors *

The Client is responsible for making all payments (including rollover fees) and fulfilling all other obligations to contractors. Where contractors are models, the Client is responsible for obtaining all necessary model releases. To ensure proper recording of others’ intellectual property rights, which may be part of the Photographic Works, the Client shall, on a request by the Photographer, provide evidence of these model releases to the Photographer. Where the Client requests the Photographer to engage contractors, the Photographer shall do so as agent for the Client and the Client indemnifies the Photographer against all costs, disbursements and other obligations arising from that agency.

Photographer Not Liable For Losses

Except as provided by the Consumer Guarantees Act 1993, the Photographer shall not be liable for:

a Any loss or damage arising by reason of any delay in the completion of the Photographic Works; or b Any loss of profits or revenues; or c Any indirect or consequential loss of whatever nature; or d Any loss resulting from any errors or omissions arising from an oversight or

a misinterpretation of a Client’s verbal instructions.

Back Up *

Once the images have been delivered to the clients Aurora Lane Photography is no longer responsible for loss of images or for maintaining back ups of the client's images.

Packages And Price List *

I have read through the packages and price list.

Arriving Early/Late *

The session starts at the agreed upon time. If you arrive more than 15 minutes before your session I will not be ready to receive you. If you are running late please inform Lindy 021803114 as soon as you can. If you are more than 25 minutes late your session may be rescheduled, at the photographers discretion, should your session conflict with another booking on the same date due to running overtime from starting late.

Agreement *
